I think he'd argue that he was absent the mens rea necessary for a conviction, but the Germans also tried out the 'I was just following orders' defense, too -- and look how they ended up. Personally, I think he's full of it, but I don't think that part of his testimony is the biggest problem. I think he's going to have a lot more problem with the part where he accused the entire armed force with widespread and systemic war crimes and the US of "murdering 200,000 Vietnamese a year". I served in the "Brownwater Navy" in 1969, way down south in the Mekong Delta. I was the officer in charge of base security at a river patrol base. John Kerry's story of how he shot a wounded VC when nobody was looking doesn't make sense to me. Did he really run his boat aground "in the middle of the enemy position"? Why did he leave his crew aboard while he went running after a wounded VC? Isn't "in the middle of an enemy position" the place to get caught in a crossfire? What is the real story of why he shot the VC? It mutates more often than the flu virus. Did he deliver the "coup de gras" (mercy killing)? When he discovered that was murder, he changed his story twice. The VC was running to get reinforcements, so Kerry shot him in the back. Or, if you don't believe that, "It was him or me. He had a B-40 rocket lanuncher. He could have killed me and my entire crew. If one wounded VC could have killed Kerry and his entire crew, then what the (bleep) was he doing beaching his boat in the middle of the emmemy position? Did it not occur to him that there might be a few more VC around with more B-40s. The whole thing stinks. Kerry is either a reckless idiot, who is unfit to command a Swift, let alone be Commander in Chief. Or the whole story is a lie, and his Silver Star completely bogus. Well I say that Kerry is guilty of war crimes as he has stated, but not nearly to the extent that G. W. Bush is. Starting a "pre-emptive" war based on blatantly hyped up intelligence while killing at least ten thousand civilians surely is much more serious than what that scumbag Kerry pulled off in Vietnam. The heroic John Kerry served less than 5 months as CO of his Swift boat. Why ? Turns out the Navy has rule that allows a sailor wounded 3 times to ask to be removed from the front lines. So this "heroic" officer abandoned his crew after his third "wounding". By his own admission none of his injuries actually kept him from duty. All shrapnel wounds, no bullet wounds. Kerry served 4 months in 'Nam, he was injured three times (the first being in his first 24 hours in Vietnam). He WILL NOT release the details of his injuries for the public to see (I am speculating that he stubbed his toe). Additionally, he eventually got out of Vietnam because he wanted to run for office and a senator gave him a "early out". Yeah, the war was about installing a pro usa democracy in the mid-east to change the cycle of propaganda there. Bush just thought it would be easiest to sell it on the WMD thread, because everyone thought saddam had them (Remember Halabja? And when they cleared out the inspectors in the 90's should we believe he didn't have them?) With Iraqis making about $1600 a year under saddam, they can see how they can have a better life.(consequently, kuwait is just to the east and much smaller, and median income is about $15000; saddam really stole a lot from his own people as you can see) Then maybe the citizens won't blindly follow the local terrorist group, dictator, ayatollah, mujadeen, or whoever else will deceive them. Almost all John Kerry's crewmates are on the road campaigning for him, and it isn't because he was magically thrown into enemy fire with a bunch of Democrats. Ask them whether or not he deserves his medals. The fact is war is rough and has the potential to bring out the best and worst in people. He testified about free fire zones and search and destroy missions because he felt he was given orders by his superiors that violated international law. The whole reason he testified in the first place was to show Vietnam was a mess and that the truth needed to get out about the problems there. He could have been a nice little boy and kept quiet. But he made a choice to speak out against his government, and that's a leadership quality. The message I'm getting from this whole new generation of anti-Kerry, anti-Clinton types which is just as bitter and angry as the McCarthyism croud from the last generation is not to question authority, but only half of authority. As an Independent, I am having a really difficult time with this election. Right now it seems that Bush is "the lesser of two evils". Kerry hasn't shown me that he FIRMLY stands for anything. Although Bush does hold firm beliefs, I have a hard time agreeing with many of them. This is the second presidential election in a row where voters are being forced to vote for the candidate they are least uncomfortable with. Dog Jaw: While I agree with your overall feeling (i.e. the lesser of two evils), as to this specific subject, I don't see any comparison with what Kerry said he did (his self-described atrocities) and a debate over whether something is legal or a supposed war crime. What you cite from MSNBC talks about some pretty murky legal stuff which could be interpreted either way. I'm a Vietnamese and lived through the Vietnam War. I would have to say that John Kerry is such a loser, an embarrassment of the United State, and a betrayer. He doesn't even know how Viet Cong is like, he'd never once lived in the Commumist county as normal people to feel how it's like without FREEDOM. You don't even have freedom to pee without the Communist Gov's permission. Millions of Vietnamese people had to flee away from their own country, regardless where they'd end up on the sea, rather than living with idiot Communist, meanwhile, Kerry and Jane Fonda yelled "The American should be on their knees to pray for living in the Communist Society."
